These terms explain how we work, what things cost, and what you are agreeing to. Everything here is a summary of our written Service Agreement. If anything on this website conflicts with that signed Agreement, the Agreement governs.
All services provided by On The Level Websites are subject to a signed Service Agreement, which governs in the event of any conflict with information on this website. On The Level Websites does not guarantee specific results, such as search rankings, leads, or revenue, from any website built or hosted by us.
1. Who you are dealing with
On The Level Websites is operated by George Jacobsen, an individual doing business as On The Level Websites, based in Chico, California and serving clients nationwide. We are an independent contractor, not your employee, partner, or agent.
By submitting our intake form, accepting a quote, or using any service we provide, you confirm you are at least 18 and have authority to enter this agreement on behalf of your business.
2. What we build
A standard build is a five-page website consisting of a home page, a services and pricing page, a photo gallery, a contact page with click-to-call, contact form, and social links, and an about page.
Additional pages, features, or custom functionality beyond those five pages are not included and are billed separately as an add-on or under a written change order.
Timeline: a straightforward five-page build usually takes about a week once you have given us everything we need. The Service Agreement sets the estimated build window at two to three weeks, and that is the number that governs, because plenty of builds are not straightforward.
What moves it: how fast your photos, logo and answers come in, how many pages you want beyond the standard five, and any add-ons running alongside the build — logo design, Google Business Profile setup, review cards, print and merch work. Each of those is separate work and adds time on top of the site itself.
Either way it is an estimate, not a guaranteed delivery date. If we expect your build to run past that window, we will tell you. Delays caused by materials or approvals arriving late, by third-party services, or by circumstances outside our reasonable control do not put us in breach.
3. Pricing and payment
You choose one of two options at signing:
- Pay in Full — $697, due once you have approved the finished site
- Payment Plan — $837 total, paid as six monthly installments of $139.50, with the first installment due when the site goes live
No payment of any kind is required before work begins or during the build. Payment is due only once you have reviewed and approved the completed site.
All fees are non-refundable once paid. Website builds typically take 2–3 weeks depending on how quickly materials are provided, and occasionally longer depending on our workload; this is an estimate, not a guaranteed delivery date.
$837 total reflects the higher price for spreading payment over 6 months. This is a time-price differential for the website design service, not a loan. You are paying for design services; the difference compensates for deferred payment.
Fees paid are non-refundable, and payment owed cannot be withheld, offset, or delayed on account of a dispute, dissatisfaction, or other claim.
Prices do not include applicable sales, use, or similar taxes. If any such tax applies, you are responsible for it in addition to the fees stated.
4. Payment plan terms
If you select the Payment Plan:
- Payments are due monthly, on time, for six consecutive months
- A late fee of $15 applies for each seven-day period a payment remains outstanding
- If a payment is not made within 30 days of its due date, the plan is automatically canceled
- All payments made before cancellation, including late fees, are non-refundable
- On cancellation, the website is taken offline until the full remaining balance is paid in a single lump sum
- The monthly plan is not reinstated once canceled
- If the remaining balance is not paid within 60 additional days and you have not responded to our attempts to reach you by phone, text, or email, we may permanently delete the website with no further obligation to retain or restore it
Where installments are charged automatically to a saved card, you will be asked to authorize the following before the first charge: by continuing, you authorize On The Level Websites to charge your card $139.50/month for 6 months, or until you cancel per the terms of your Service Agreement.
5. Hosting and maintenance
After launch, hosting, domain management, and minor maintenance are $37 per month, billed separately from the build fee.
Hosting is $37/month and may increase over time with 30 days’ written notice. Includes up to 4 photo updates per month and covers any technical issues that come up — no extra charge. General content/text updates aren’t included; more frequent photo updates are available via the Photo gallery update add-on — $25 for up to 10 photos. Professional email is not included; you can sign up for Google Workspace (or similar) directly through Google at your own cost.
Included in the $37 monthly rate, you may request up to four photo updates per month at no additional charge. General content updates, meaning text changes, new written content, or page edits beyond photo updates, are not included and are billed as an add-on or under a written change order. If you need more frequent photo updates, the Photo gallery update add-on covers up to 10 photos for $25.
Professional email is not included in the $37 rate. If you want an email address on your website’s domain, you can sign up directly for Google Workspace or a similar service through Google. Pricing, sign-up, and ongoing account management for that email service are between you and Google, and are your responsibility. We are not responsible for the cost, setup, or maintenance of your email service unless separately agreed in writing as an add-on.
- The $37 rate covers the standard five-page site
- Adding pages or features increases the hosting rate; you will be notified and agree in writing before the new rate takes effect
- We may increase the standard rate with at least 30 days’ written notice by email or text. If you do not accept the new rate you may cancel before it takes effect; continued use after that date means you accept it
- Hosting is billed monthly from launch until you cancel in writing
- If the site goes down due to hosting or technical issues on our end, fixing it is our responsibility at no cost to you
- We make reasonable efforts to maintain periodic backups, but do not guarantee a complete or recent backup exists at any given time. After a hosting failure, cyberattack, or data loss we will make commercially reasonable efforts to restore from the most recent available backup; no specific timeframe is guaranteed and full restoration may not always be possible
- If hosting payment is more than 30 days past due we may take the site offline until the account is current, after making a reasonable attempt to contact you
- If the account remains unpaid and you do not respond for 60 additional days, we may permanently delete the website files and account
Cancelling hosting: you may cancel at any time with written notice. If you have paid for the website in full, you are entitled to a copy of your website files and may host elsewhere.
We will provide the files within ten business days of your request at no charge, provided it requires no more than a reasonable, minimal amount of effort. You are responsible for third-party costs such as new hosting or domain transfer fees. If the transfer requires significant additional work, we will disclose and agree any fee with you in advance.
6. Revisions
Reasonable revisions to design, layout, and content are included during the build, before your final approval, limited to two rounds of revisions per page.
Additional rounds, and any revisions requested after final approval, are billed as add-ons or under a written change order. Once the site is approved and launched, changes beyond the minor maintenance included in hosting are likewise billed separately.
7. Ownership
- Once payment is made in full, you own the final website content and design created for you. Until then, all work product remains our property
- Your domain name belongs to you. You are responsible for renewing it and paying associated fees. We are not liable for expiration or loss due to non-renewal, though we will make reasonable efforts to notify you of an approaching renewal if we manage the domain
- Your Google Business Profile remains under your ownership at all times. We may be added as a Manager to assist, but never as Owner
- You create and own your social media accounts. We may link to them from your site but do not create, manage, or control them unless separately agreed in writing
- We retain the right to display your completed website in our portfolio and marketing materials unless you request otherwise in writing
8. What we need from you
You agree to provide business information, photos, logins, and other requested materials in a timely manner. Delays in providing them will delay the project.
If you do not provide requested materials, approvals, or feedback within 30 days of the request, we may pause the project. If you do not respond to follow-up attempts by phone, text, or email within an additional 15 days, we may terminate the agreement for non-responsiveness.
9. Your content and legal compliance
You represent that all photos, logos, text, and other content you provide are either owned by you or that you have the legal right to use them. You agree to indemnify, defend, and hold us harmless from any claim, damages, liability, and reasonable attorneys’ fees arising from content you provided, including claims of copyright infringement.
You are solely responsible for ensuring your website content complies with all applicable federal, state, and local laws, including any advertising or licensing disclosure requirements that apply to your business, such as contractor licensing disclosure laws in your state. We are not responsible for verifying your compliance.
We do not guarantee your website meets any particular accessibility standard, including WCAG or requirements under the ADA or similar state or local laws. You are solely responsible for meeting any accessibility standard applicable to your business, and you agree to indemnify and hold us harmless from any claim arising from your website’s accessibility.
If your website collects visitor information through a contact form or similar feature, you are solely responsible for maintaining any privacy policy, cookie disclosure, or consent mechanism required by applicable law, and for how that information is used and stored.
10. Add-ons
Services beyond the standard five-page site are available at additional cost, including logo design, professional email, Google Business Profile optimization, review link and QR cards, photo gallery updates, print and merchandise design, SEO packages, and additional pages.
Add-on pricing is provided and agreed in writing, including by email or text, before any add-on work begins or is billed.
11. Third-party services
Your website may use third-party themes, plugins, stock photography, fonts, or other licensed assets. We are not liable for price changes, discontinuation, or compatibility issues from third-party tools outside our control. If a third-party tool requires an ongoing license or subscription fee, that is separate from and in addition to our fees, and will be disclosed to you before it is incurred.
12. Content and platform compliance
We may decline to publish, or may remove, content that is illegal, infringing, defamatory, or that violates the terms of service of our hosting or other third-party platforms. We are not liable if a hosting provider or platform suspends, restricts, or terminates your website or account as a result of content you provided or your use of the website.
13. Referral program
You may be eligible for referral credit or cash compensation for referring a new customer who signs on for a website, under our current referral program terms. Referral compensation applies only to the website purchase itself, not to standalone add-ons.
14. Confidentiality
Each of us agrees to keep confidential any non-public business, technical, financial, or personal information disclosed by the other, including login credentials, pricing, and business strategies. Neither will disclose it to third parties except as necessary to perform the work, with consent, or as required by law. This obligation survives termination.
15. Circumstances beyond our control
Neither party is liable for delay or failure to perform, excluding payment obligations, due to causes beyond reasonable control, including acts of God, natural disasters, internet or hosting outages, data loss caused by a third-party hosting platform, cyberattacks, or power failures.
16. Warranty disclaimer
The website and services are provided as is, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement, other than as expressly stated in the Service Agreement. We do not guarantee the website will be error-free or uninterrupted at all times, but will make reasonable, good-faith efforts to promptly address and fix any issues.
17. Limitation of liability
We make no guarantee of specific results, including search engine rankings, lead volume, or revenue generated as a result of your website.
Our total liability, however arising, will not exceed the total amount you actually paid us in the twelve months preceding the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits or lost business, even if advised of the possibility.
Your sole and exclusive remedy is monetary damages as limited above. In any dispute or legal action, the prevailing party is entitled to recover reasonable attorneys’ fees and costs.
18. Termination
- Either party may terminate in writing before your website launches. If you terminate before launch, you owe nothing, since no payment is due before completion
- After launch you may cancel hosting and maintenance at any time with written notice. If you want to host elsewhere rather than take the site offline, we will provide your website files as described above
- Cancellation of the Payment Plan for a missed payment is governed by section 4
19. Notices
Any written notice may be delivered by email, text message, or physical mail to the contact information each party has provided, or later updated in writing. Notice is considered given when sent to the most recent contact information on file.
20. Disputes, venue, and governing law
Any dispute will first be addressed informally between us in good faith. If it cannot be resolved informally, it will be resolved in the small claims or applicable court of Butte County, California, regardless of your state of residence. Both parties consent to venue and jurisdiction in Butte County, California.
This agreement is governed by the laws of the State of California, without regard to its conflict of laws principles.
21. Everything else
If any provision is found invalid or unenforceable, the rest remains in full force, and the invalid provision will be modified to the minimum extent necessary to make it enforceable while preserving its original intent. Neither party may assign this agreement without the other’s written consent, except that we may assign it in connection with a sale or transfer of the business. No waiver of a breach is a waiver of any later breach.
Agreements may be signed electronically, including by typed or electronic signature or by exchanging signed copies via email or text. An electronic signature is valid and binding to the same extent as an original.
The signed Service Agreement, together with any signed add-on or change order, is the entire agreement between us and supersedes prior discussions, quotes, or understandings. It may only be modified by a written amendment agreed to by both parties.
